About Medical Marijuana In Missouri

Since 2014, marijuana has been largely decriminalized in Missouri. Senate Bill 491 eliminated the penalty for first-time possession of 10 grams or less and reduced the penalties for sale and cultivation. The state didn’t have the structure for a full medicinal marijuana program until November 2018, however.

Amendment 2 legalized medical marijuana in Missouri, defeating two more conservative propositions on the same ballot. Amendment 3 would have allowed fewer qualifying circumstances, prohibited home production, and imposed a 15 percent tax rate. Instead of a constitutional amendment, Proposition C would have been a legislative change. It would have imposed a 2% tax on cannabis but would not have allowed home cultivation.

The current law, Amendment 2, imposes a 4% tax rate, expands the list of qualifying conditions, and allows for home cultivation. It was by far the most liberal option on the November 2018 ballot in Missouri, and it won by a large margin. In actuality, Amendment 3 received only 32% of the vote, while Proposition C received only 44%. In contrast, 66 percent of voters backed Amendment 2, which is more liberal.

The Department of Health and Senior Services (DHSS) has over 160,000 medicinal marijuana patients registered, making Missouri’s program the eighth largest in the country by enrollment. By July 2022, the state hopes to have over 200,000 total registered patients. This would equate to around 3% of the overall population of the state. The new medicinal market has boosted the state’s economy by nearly 6,000 employment, and cannabis sales surpassed $200 million in 2021, with the program continuing to expand at a rapid pace.

Signature gathering for a recreational legalization initiative is currently underway. The initiative’s supporters have until May 8, 2022 to collect 170,000 signatures. The bill would impose a 6% tax on recreational cannabis sales, with localities having the option of adding an extra 3% tax. Non-violent cannabis crimes would be instantly expunged, and 144 new recreational licenses would be added. Supporters of the initiative can add their signature to a map of signing sites.
